FUSED FABRICATIONS TERMS & CONDITIONS

Definitions and Interpretations

  1. In these terms and conditions:
    (a) ‘Agreement’ means the agreement between Fused Fabrications and the Purchaser to provide Goods subject to these terms and conditions.
    (b) ‘Fused Fabrications’ means FUSED FABRICATIONS PTY LTD.
    (c) ‘Goods’ means the products and services supplied by Fused Fabrications to the Purchaser.
    (d) ‘Purchaser’ means the purchaser of the Goods.
    (e) ‘Quotation’ means any quotation given by Fused Fabrications to the Purchaser.
    (f) ‘PPSA’ means the Personal Property Securities Act 2009 (Cth).

General Terms

  1. By accessing and using this website, you agree to comply with and be bound by the following Terms & Conditions. These terms may be updated at any time without notice. It is your responsibility to review them periodically.

Quotations

  1. Any written Quotation will remain valid for 7 days from the date of issue, unless otherwise stated in the Quotation.
  2. The Purchaser acknowledges and agrees that:
    (a) it is their responsibility to verify that Goods are fit for purpose;
    (b) prices in the Quotation unless specifically stated otherwise are exclusive of GST, freight and other taxes, duties and charges;
    (c) all Quotations are strictly confidential and will not be disclosed to any other party;
    (d) the prices in the Quotation may vary after the date of issue and they will pay for additional charges as required by Fused Fabrications or any other party.

Orders & Cancellations

  1. Orders (verbal or written) imply acceptance of the Quotation and these Terms & Conditions.
  2. Files are considered final at the time of order.
  3. Orders may not be varied or cancelled without written consent from Fused Fabrications. Where cancellation is accepted, the Purchaser may be liable for incurred costs.

Pricing & Payment Terms

  1. Payment must be made prior to the completion of any works unless a credit facility is granted by Fused Fabrications to the Purchaser.
  2. If a credit facility is granted, Fused Fabrications will invoice the Purchaser for Goods at the time of supply. All invoices are due and payable within the agreed upon term, or when the approved line of credit is reached.
  3. The Purchaser acknowledges and agrees that Fused Fabrications is authorised to allocate the payment of any monies received from the Purchaser against any outstanding Fused Fabrications account of the Purchaser.
  4. If the Purchaser defaults in making payment in accordance with these terms and conditions, Fused Fabrications may in its absolute discretion and without notice:
    (a) suspend payment discounts;
    (b) withdraw the approval of a credit facility and refuse any subsequent orders from the Purchaser for the supply of Goods.
  5. The Supplier reserves the right to withdraw credit at any time, whether the Applicant is in default under the terms of this agreement or not.
  6. Upon cancellation with or without notice all liabilities incurred by the Applicant become immediately due and payable to the Supplier.

Privacy & Credit Checks

  1. In line with the Privacy Act 1988, the Purchaser authorises Fused Fabrications to:
    (a) Seek or disclose personal information to credit agencies.
    (b) Contact trade references.
    (c) Disclose information related to creditworthiness.

Shipping & Delivery

Fused Fabrications offers shipping across Australia for select products. Shipping terms vary depending on the item type:

Bull Bars

We ship bull bars Australia-wide. Due to the size and freight handling requirements of bull bars, we only deliver to:

  • A commercial address with a forklift on-site; or
  • An approved freight depot (for customer pickup).

It is the customer’s responsibility to provide an accurate delivery address. If a delivery location is falsely declared as a commercial address and is later determined to be residential, inaccessible, or not equipped for unloading, any futile delivery charges, redelivery fees, or depot storage costs incurred will be passed on to the customer. These charges must be paid in full before redelivery or release of goods.
We reserve the right to cancel or delay any order if delivery conditions are not met.

Laser Cut Components

Shipping of laser cut components is handled case-by-case, depending on size, weight, and location. Some items may require pickup only from our workshop. Please contact us before ordering to confirm shipping availability.

General Shipping Terms

  • All delivery timeframes are estimates only and are not guaranteed.
  • Once goods leave our premises, they are the property and responsibility of the purchaser.
  • All shipments are sent at the buyer’s risk.
  • Fused Fabrications accepts no responsibility for damage, loss, or delays that occur during transit.
  • We strongly recommend that customers arrange freight insurance if they require added protection during shipping.

Damage Notification Requirement

All goods must be inspected immediately upon delivery.
Any damage—whether suspected to be caused by freight or a manufacturing fault—must be reported to Fused Fabrications within 72 hours of receipt. Damage reported outside this timeframe will be classified as wear and tear and will not be eligible for warranty assessment.
This policy applies regardless of the suspected cause of damage. We are not liable for any claims made outside the 72-hour window, even if it is believed the damage occurred prior to dispatch.

Carrier Terms & Conditions

By placing an order with Fused Fabrications, the customer agrees to be bound by the Terms & Conditions of our nominated freight carrier. For shipments made via TNT, this includes the full TNT Terms and Conditions of Carriage and Other Services (effective 1 May 2024), available here 

These carrier terms apply in addition to Fused Fabrications’ policies.

Returns & Refunds

Fused Fabrications does not accept change-of-mind returns. We comply with Australian Consumer Law, which entitles you to a repair, replacement, or refund if a product is faulty, not fit for purpose, or significantly different from its description.

For all warranty inquiries, please contact us directly with supporting images and a description of the issue.

Product Suitability & Disclaimer

The Purchaser is responsible for ensuring Goods are suitable for their intended use.

Nothing in these Terms excludes statutory rights or liability for:

  • Fraud
  • Death or personal injury due to negligence
  • Obligations under Australian Consumer Law
  • Any other non-excludable rights under law

Fused Fabrications is not responsible for misuse, incorrect installation, or non-intended use of products.

Manufacturing Conditions & Accuracy

  1. All files must be supplied at a 1:1 scale and are cut as provided. It is the responsibility of the customer to ensure files are cut ready.
  2. Accuracy is not guaranteed if physical parts are supplied as reference.
  3. If folding is required:
  4. The bend radius is determined by tooling. Files supplied with a bend radius that does not conform to the machine/tooling will result in final dimensions that are not consistent with supplied drawings.
  5. Flat patterns must match supplied cut files exactly.
  6. Dimensions must be labelled externally for accuracy.
  7. Material is flat sheet/plate unless otherwise specified.
  8. Material may not remain scratch-free during processing.
  9. The purchaser shall ensure that his/her User Content, and his/her and our use of it, does not infringe anyone’s copyright.

Ownership of Scrap Metal

Unless otherwise requested in writing at the time of quote, Fused Fabrications retains ownership of offcuts and scrap material.

Intellectual Property & Copyright

  1. Fused Fabrications retains copyright and ownership of all designs unless otherwise agreed.
  2. Where the Purchaser supplies designs, they warrant that:
    (a)Their use does not infringe third-party rights.
    (b) They indemnify Fused Fabrications from any related claims.
  3. All website content is the property of Fused Fabrications and may not be reproduced without written permission.

Important Product Disclaimer – Off-Road Use Only

Some products sold by Fused Fabrications—including but not limited to our bull bars—are not airbag compatible, not ADR compliant, and are not intended for on-road or highway use. These products are designed strictly for off-road use only.
By purchasing these products, you acknowledge and agree to this limitation and accept all associated risks.

Buyer Responsibility

It is solely the responsibility of the purchaser and/or installer to ensure that any product purchased from Fused Fabrications is correctly fitted and used appropriately for its intended purpose. We do not guarantee compatibility with airbags or other vehicle safety systems, and we make no claims that our products meet road legality or registration standards in any state or territory.

No Liability for Misuse or Incorrect Fitment

Fused Fabrications accepts no liability for injury, damage, or loss resulting from misuse, incorrect installation, modification, or use of any product in a manner inconsistent with its intended off-road use. Installation should be performed by a qualified professional. Using our products on public roads may violate local vehicle safety laws and could affect your insurance or vehicle registration status.

Assumption of Risk

By purchasing and/or installing our products, you agree to assume full responsibility for any risks associated with their use and release Fused Fabrications, its owners, employees, and affiliates from any and all claims, liabilities, or damages.

Warranty

Fused Fabrications offers a 12-month limited warranty on all products from the date of purchase. This warranty covers defects in materials and workmanship under normal use.

Please inspect your order upon receiving and contact us immediately if the item is defective, damaged, or if you receive the wrong item. Prompt reporting helps us assess and resolve issues quickly and effectively.

To qualify for a warranty claim:

  • Products must not have been altered, modified, or used in an unintended manner.

Exclusions

This warranty does not cover:

  • General wear and tear
  • Misuse, neglect, or improper installation
  • Damage caused by freight
  • Products installed or used in a way that contradicts the intended off-road purpose

Warranty Process

To lodge a warranty claim, please email us with:

  • Your order number
  • A detailed description of the issue
  • Photos showing the affected area(s)

We will assess all claims in line with Australian Consumer Law and our warranty terms. Approved claims may result in repair, replacement, or refund, at our discretion.
This 12-month limited warranty is offered in addition to your rights under Australian Consumer Law, which may entitle you to remedies beyond this period depending on the circumstances.

Force Majeure

Fused Fabrications shall not be liable for any failure or delay in performance due to circumstances beyond its control.

Use of Images

By ordering from Fused Fabrications, the Purchaser consents to the use of images of finished work for advertising and promotional purposes.

Material Grade

Unless otherwise specified in writing, material grade is at the discretion of Fused Fabrications.

Website Use

By accessing the Fused Fabrications website, you agree to be bound by these Terms & Conditions, which may be updated without notice.

Governing Law

These Terms & Conditions are governed by the laws of Victoria, Australia. Any disputes arising from use of this website or products will be subject to the exclusive jurisdiction of the courts of Victoria
